He was predeceased by: his wife Dona M. Haggard Payne; his parents, John Elmer Payne and Elizabeth M. Payne of Sweetens Cove; his brother Houston A. Payne of Stevenson, Ala; and his half-brother Lewis A. Sumpter of Los Molinos.
