He was predeceased by: his daughter Sandra Staten (Cleversy); his former wife Betty Jean (Maltry); his wife Clara Eckerfield; his parents, George Staten and Mary Staten (Bessenyin); and his siblings, George Staten Jr., Charlotte Staten (Wienhold), Mary Jane Staten (Spondike) and Irene Staten (Becker).

He is survived by: his children, Martha, James P. Staten, Jr., Melinda of Perry, OH and Dan Staten (Cleavenger) of Vista, CA; his grandchildren, Nicholas Staten (Kym Baldwin), Jason Staten, Thomas, Elaina Cleversy, Michael, Robyn Cleavenger (Raupe), Ross and Rachael Long (Cleavenger); and his great grandchildren, Elyjah Staten, Delaney Staten, Madilynn Miller, Nora Vickery, Rush Long, Winnie Long, Goldie Long, Amelie and Charlotte Cleavenger.
