He was predeceased by: his parents, Clarence Brooks and Ora Bell Brooks (Quinn). He is survived by: his former wife Jane M. Schetzler; his wife Jane Brooks; his children, Ora Marie Davis (Chris Davis) of Jefferson City, Billy W. Brooks (Samantha Pierson) of Jefferson City, Clarence L. Brooks (My Thi Brooks) of Jefferson City, Briar L. Brooks (Samantha Lister) of Jefferson City and Herschel L. Brooks, Jr. of Jefferson City; his siblings, Geraldine Riddle (Jerry) of Holcomb, Joyce Wiseman (Red) of Clarkton and Bill Brooks (Betty Hill) of Gedion; his grandchildren, Brandy Marie Brooks and Christopher Emmit Lee Davis, Jr.; and his sister-in-law Linda Schetzler of Jefferson City. He is also survived by numerous nieces and nephews.

In lieu of flowers, memorials are suggested to the Herschel Brooks Memorial Fund.
