He was predeceased by: his parents, Ruby Fitzgerald and Edward Fitzgerald. He is survived by: his wife Kathy; his children, John, Jennifer and Mary Kate (Keeter); his son-in-law Adam Keeter; his sibling-in-law Sally; and his former wife Gwen Fitzgerald. He is also survived by many nieces and nephews. Tom's generous and loving spirit and gregarious personality will be greatly missed by his family and friends.

“I am so sorry for the family's loss. I got the honor of meeting Judge Fitzgerald when I started working at the Court of Appeals in the early 90's as a court bailiff. He was always helpful and kind to a fault. He was always so proud of his family and their achievements. Whenever I was around him, he went out of the way to make me feel important. Judge Fitzgerald swore me into the bar and went out of his way to make my family and I feel special. Judge Fitzgerald was the hardest working Judge at the Court, a great jurist, and just an all around great person. He was one of a kind and will be missed. I am glad I got to know him. Kurt & Kathy Hatfield and family.”
