He was predeceased by: his father Harry Avery. He is survived by: his former wife Judy Bagwell; his wife Kimberly Keith Avery; his stepchild Allisandra Fikes; his daughter Cheri Wright (Anthony); his granddaughter Lillian; his daughter Samantha Adams (Kyle); his granddaughters, Rosalyn and Elaine; his son Joel Avery (Destiny); his granddaughter Scarlett; his daughter Hazel Avery of Harrisonville, MO.; his mother Rosalyn Evans (Kenneth); his brother Eric Avery (Della); his nieces, Amy Chewning (Scott) and Ashley Bravo (Gregg); his brother Brent Avery (Angela); his nieces and nephews, Justin Avery, Amanda Nam (Kido) of Seoul, Lindsey and Blake Avery; and his uncles, Lytle Arnold and Wendell Arnold.

During the pandemic year 2020, they attempted to move back to Galveston, TX near Kim's family, but illness necessitated Benjie be near his doctors, so they settled in Belton, MO.
