He was predeceased by: his parents, Hoyt Ervin Burton and Janice Lynn Lawson Fincher; and his daughter Makayla Marie Burton. He is survived by: his wife Kimberly Jones Burton; his sons, Hoyt Richard Burton of Tallapoosa and David Eli Burton of Tallapoosa; his brother Hoyt Joseph "Joey"; his sister-in-law Chastity Burton of Altoona, Alabama.; and his nieces and nephews, Codi Lynn, Brianna, Dakota and Trae. He is also survived by great nieces and nephews and other family members.
