He was predeceased by: his parents, Jesus Avitia and Candelaria Avitia (Misclez). He is survived by: his wife Cora Minjarez; his children, Gildardo Avitia of Johnson, Tina Olivas of Las Cruces and Alicia Avitia of Johnson; and his sisters, Ramona Torres of Newton, Chavela Ruiz of Denton, Texas and Carmelina Ruiz of Denton, Texas. He is also survived by six grandchildren and one great-grandchild.
